I'm doubtful that the ITC and the Obama administration would go through and approve the ban. That would have huge impacts on the gaming market, and greatly reduce competition (essentially reducing it to none, since the Wii doesn't count).

Note that the ban only mentions Microsoft's current 4GB and 250GB systems

Depending on the outcome of the court case (i.e whether or not the sale is simply stopped or further costs are incurred), this could ironically prove to be good news for Microsoft, they get to limit users to the more expensive 320GB system towards the end of the product's lifecycle without any of the negative publicity they would have received for cutting the 250 model themselves.
